In a recent development, the Indian government has announced new guidelines for social media platforms and digital news outlets. These guidelines aim to regulate online content and ensure transparency in the digital space. The new rules require social media platforms like Facebook, Twitter, and Instagram to establish a grievance redressal mechanism for resolving user complaints. They also mandate these platforms to appoint a Chief Compliance Officer, a Nodal Contact Person, and a Resident Grievance Officer who must be residents of India. Additionally, the guidelines require social media companies to disclose the origin of any “mischievous” message or content as deemed necessary by government agencies. For digital news outlets, the rules stipulate that they must follow the journalistic conduct of the Press Council of India and the Programme Code under the Cable Television Networks Regulation Act. The guidelines also state that digital news platforms must disclose their ownership details and ensure that their content does not affect India’s sovereignty and integrity. Failure to comply with these guidelines could result in the loss of intermediary status for social media platforms, making them liable for criminal action in case of unlawful content. These new regulations mark a significant step towards regulating the digital space in India and ensuring accountability among online platforms and news outlets.
