The petition challenging the current provisions was filed by advocate Ashwini Kumar Upadhyay

who argued that allowing convicted politicians to contest elections after serving a six-year ban undermined the fight against corruption. Upadhyay contended that a lifetime ban was necessary to maintain the integrity of the electoral process and prevent tainted individuals from holding public office. The Supreme Court has sought responses from the Election Commission and the Centre on the matter
