An activist has approached the Nagpur bench of the Bombay High Court seeking a response from the Maharashtra University of Health Sciences (MUHS) and the state government regarding the implementation of Supreme Court guidelines on discontinuing the two-finger test. The two-finger test, which involves the insertion of fingers into a rape survivor’s vagina to determine the elasticity of the hymen, has been widely criticized for being unscientific, invasive, and retraumatizing for survivors. The Supreme Court had issued guidelines in 2013 directing all states and union territories to discontinue the practice. However, the activist claims that MUHS has not taken any steps to implement these guidelines. The petitioner has urged the court to direct MUHS and the state government to respond to the Supreme Court’s directives and to provide information on the measures taken to stop the two-finger test. The issue of the two-finger test has been a subject of debate and controversy in India, with many activists and organizations advocating for its complete abolition. The court’s intervention in this matter is crucial to ensure that survivors of sexual assault are treated with dignity and respect.
