What did the High Court decide?

The Bombay High Court has kept the leave-India notice issued to actor Imran Khan in abeyance until November 2, when his challenge is due to be heard again. The October 27 development gives him temporary protection from the notice’s October 28 departure deadline.

LiveLaw’s court report says the bench expressly recorded that the October 14 notice would remain in abeyance until the adjourned hearing. This is an interim procedural development: it does not settle whether the notice was valid or finally decide Khan’s challenge.

Why was the hearing adjourned?

According to LiveLaw, Additional Solicitor General Anil Singh asked for the matter to be deferred because Solicitor General Tushar Mehta could not join through video conference. Khan’s senior advocate, Venkatesh Dhond, drew attention to the approaching departure deadline.

Hindustan Times separately reported that the Foreigners Regional Registration Office assured the court Khan would not be required to leave on October 28. Its report also gives November 2 as the next hearing date. Both accounts describe the assurance accompanying the request for more time.

What remains before the court?

Khan is contesting the administrative direction requiring his departure. Hindustan Times identifies him as a US citizen and an Overseas Citizen of India cardholder and reports that he denies breaching the applicable rules. Those are the parties’ positions in a continuing dispute, rather than findings establishing wrongdoing.

The case follows his detention near a political protest in Mumbai earlier in October. Khan disputes the basis for the action against him, according to Hindustan Times. The immediate significance of the new hearing is the protection through November 2; a final outcome on his petition has not been announced in these reports.
